The San Jose Police Department - Controversy of Secondary Employment. ( 1995 to Present ) - A recipe for corruption.

Most Police Departments do not allow their Police Officers to work Secondary Employment doing Security or investigative work do to Conflict of Interest Concerns. The City Of San Jose Office of the Independent Police Auditor initiated a partial overhaul of SJPD's Secondary employment program in 1996 as a result of serious Police Brutality & Misconduct Concerns involving San Jose Police Officers working as bouncers for many of the Downtown San Jose Bars and Night Clubs. Information regarding this can be found in the San Jose Independent Police Auditors 1995 Year End Report which was released in April of 1996. As a result of the many horrific episodes of Police Brutality and abuses of power alleged by SJPD Officers in the Downtown San Jose,  ( EZ ) Entertainment Zone during that period, and also some serious conflict of interest related issues,  San Jose Police Officers are no longer permitted to work as Bouncers for bars and nightclubs.

C 1515 SECONDARY EMPLOYMENT WHERE ALCOHOLIC BEVERAGES ARE SERVED:

All members of the Department are prohibited from providing law enforcement or security related services for any employer or establishment whose major business is the sale and/or service of alcoholic beverages, e.g., bars, nightclubs

1995 Statistics:

In 1995, 50% of the ( CI ) Citizen-Initiated and Department Initiated ( DI ) Complaints filed against the San Jose Police Officers who worked off duty involved allegations of Unnecessary Force ( UF ) The majority of the use of force complaints originated at a bar or nightclub.

There were 927 work permits issued to 596 Police Officers with some officers having as many as three off-duty work permits on file at one time. Approximately 50% of the entire San Jose Police Department had off duty work permits issued.

The area that has generated the most calls and complaints to the Independent Police Auditor involved officers who whore San Jose Police uniforms while working off-duty.  Of the 596 officers with off-duty work permits,  352 ( 59% ) officers worked off duty in uniform. 


A frequent complaint expressed by the citizens was that officers response to non-emergency calls was slow or not forthcoming. Uniformed San Jose Police Officers working off-duty would have high visibility unlike those working off-duty wearing civilian clothes. Citizens have complained that officers were  standing idly outside bars instead
of on patrol. The public perception and expectation being that Police Officers in uniform should be willing and 
ready to serve the public. 


Conflicts of Interest concerns have arisen if a San Jose Police Officer working at a bar or nightclub would see patrons entering or leaving the establishment appearing to be intoxicated to the point where they were unable to care for themselves, or situations where a nightclub would be filled beyond legal capacity. San Jose Police Officers were placed in situations where job security at the nightclub would be in direct conflict with their duties as police officers. Obviously, officers would often be reluctant to prosecute or investigate their Secondary Employer if, for example; If the bar or nightclub where the officer were employed were to inadvertently serve an alcoholic beverage to a minor, or if the officer was aware of or witnessed the establishment violating other ABC regulations.

C 1503 SECONDARY EMPLOYMENT LAW ENFORCEMENT:

The legal authority vested in a sworn member while working in a San Jose Police
uniform
in a law enforcement or security capacity for a secondary employer is
limited to the enforcement of local and state laws. Members will not use their
police authority to enforce a secondary employer's policies and regulations.
