Know your rights. How to handle being 
stopped by the police.

Remember: You have Legal Rights, but many Police will not respect your rights. Police of any jurisdiction could violate your rights, however, with cops in San Jose, California, it seams to occur at epidemic proportions.

If the Police Stop Anyone:

 If the Police Stop you:


Document Officer's names, badge numbers, and car numbers.  
POLICE OFFICERS MUST BE IDENTIFIED BY NAME OR BADGE NUMBER. (
PC sec. 830.10 )

Document the time, date, and location of incident and all details as soon as possible.

Obtain witnesses' names and contact information.

Try to get the arrestee's name ( Only if it was already given to the police )  also, the Event number / Case number, Booking Number, etc.

Document any injuries as soon as possible. Photograph them and have a medical report explaining details of the injuries and how they occurred.












Ask, "AM I FREE TO GO?" If the police tell you that you are not, then you are being detained.  If you are not being detained, simply walk away.

If detained, Ask: "WHY AM I BEING DETAINED?"
The police officer must have a "reasonable suspicion" to suspect your involvement in a specific crime. ( Not a guess or stereotype )

It is not a crime to be without ID. If you are being detained, or being issued a ticket or citation, you may want to show your identification to the police officer. ( Because they may take you to the Police Station to verify your identity. )

If not Arrested or Detained:

If a Police Officer tries to search your vehicle, your house, or your person, say repeatedly that you DO NOT CONSENT TO THE SEARCH. ( This is especially important in San Jose because the San Jose Police may plant drugs or evidence during the search. - This could happen anywhere, but seams like a  very common practice with  many San Jose Police Officers. ) 

If in a vehicle,  do not open your trunk or door





If you are arrested by the Police:


The Police may handcuff you, search you, and fingerprint you.

Say repeatedly: "I do not want to speak until my lawyer/public defender arrives."

Do not talk to inmates in jail about your case

If you are on Probation/Parole, tell your PO that you have been arrested, and NOTHING MORE.


 

Say 'NO' to police searches...
